Terms of service
OVERVIEW
Welcome to KULT ARCHIVE! The terms "we", "us" and "our" refer to KULT ARCHIVE, a Norwegian sole proprietorship (enkeltpersonforetak) with organisation number 937 451 423, registered for VAT (MVA). Our full company and contact details are listed in Section 25 below and in our Legal notice.
KULT ARCHIVE operates this store and website, including all related information, content, features, tools, products and services, in order to provide you, the customer, with a curated shopping experience (the "Services"). We sell gothic clothing and accessories from brands such as Videnoir and Restyle, as well as our own handmade stainless-steel chainmaille. KULT ARCHIVE is powered by Shopify, which enables us to provide the Services to you.
The terms and conditions below, together with the policies referred to in them (these "Terms of Service" or "Terms"), describe your rights and responsibilities when you use the Services and buy from us. These Terms apply in addition to our Refund policy, Shipping policy and Privacy policy.
If you buy as a consumer, you always keep the rights you have under mandatory consumer law, including the Norwegian Consumer Purchases Act (forbrukerkjøpsloven) and the Norwegian Cancellation Act (angrerettloven), and, if you live in another EEA country, any mandatory consumer protection rules of your country of residence. Nothing in these Terms limits those rights.
By visiting, interacting with or using our Services, you agree to these Terms of Service. Please also read our Privacy policy. If you do not agree to these Terms, you should not use or access our Services.
SECTION 1 - ACCESS AND ACCOUNT
To buy from us you must be at least 18 years old, or have the consent of a parent or guardian.
To use the Services, including browsing our online store or buying any of our products, you may be asked to provide certain information, such as your email address, billing, payment and shipping information. You confirm that the information you provide is correct, current and complete and that you have the right to provide it.
If you create a customer account, you are responsible for keeping your login details secure and for activity on your account. You may not transfer, sell, assign or license your account to anyone else.
SECTION 2 - OUR PRODUCTS
We make every effort to describe and photograph our products accurately. Colours and appearance may look slightly different on your screen depending on your device and its settings.
Our chainmaille is handmade from stainless steel, piece by piece. Small variations between pieces are a natural part of handmade work and are not a defect. Products must still match the description given on the product page, and your rights if a product has a defect are described in Section 3.6.
We may change product descriptions, discontinue products, or limit the quantities we sell to any person or to any country. Such changes do not affect orders we have already confirmed.
SECTION 3 - ORDERS, PRE-ORDERS AND MADE-TO-ORDER ITEMS
3.1 How a purchase is made. When you place an order, you are making an offer to buy. A binding agreement is formed when we send you an order confirmation by email. We may decline an order before we have confirmed it, for example if a product is no longer available or the order appears to be fraudulent. If we decline, change or cancel an order, we will tell you using the email address or phone number you gave us, and refund any amount you have paid in full.
Our products are sold for personal use. We may decline orders that appear to be placed for commercial resale.
3.2 Pre-orders. Some products are sold as pre-orders. These are clearly marked as pre-orders on the product page, together with the expected shipping time. Pre-order items ship as soon as they arrive from the designer, usually within 1–2 weeks; see our Shipping policy. If the expected time changes, we will email you with an updated estimate. You may cancel a pre-order free of charge at any time before it ships by emailing us, and you will get a full refund. If delivery is delayed, you also have the rights described in the Consumer Purchases Act (forbrukerkjøpsloven).
3.3 Handmade and made-to-order items. Some of our handmade pieces are made after you order. Chainmaille earrings and hair clips are usually ready to ship within 2–3 business days; some pieces take longer, for example The Widow's Veil (up to 7 days). The product page always states the production time. These pieces are made in our standard designs and are covered by the 14-day right of withdrawal described in Section 3.5, unless an exception is clearly stated on the product page.
3.4 Made-to-measure and personalised items. Some pieces, such as The Prologue, are made to your own measurements or specifications after you order. Because they are made specifically for you, the right of withdrawal does not apply to them (angrerettloven § 22). This is clearly stated on the product page before you buy. Please check your measurements carefully before ordering. Your rights if the item has a defect (Section 3.6) still apply in full.
3.5 Right of withdrawal (angrerett). As a consumer you have the right to withdraw from your purchase within 14 days of receiving the goods, without giving any reason, under the Norwegian Cancellation Act (angrerettloven). To use it, send us a clear message, for example by email to hello@kultarchive.no. You pay the direct cost of returning the goods. Exceptions (personalised or made-to-measure goods, and sealed hygiene items that have been unsealed after delivery) are stated on the product page before you buy. How to return items, refund deadlines and return conditions are described in our Refund policy, which forms part of these Terms.
3.6 Defects and complaints (reklamasjon). If a product has a defect, you have the rights set out in the Norwegian Consumer Purchases Act (forbrukerkjøpsloven), including repair or replacement, a price reduction, or cancellation of the purchase with a full refund if the defect is significant, and compensation where the conditions are met. You must notify us within a reasonable time after you discovered, or should have discovered, the defect. The complaint period is two (2) years from when you received the goods, or five (5) years for goods intended to last significantly longer. Contact us at hello@kultarchive.no, preferably with photos of the issue. See also our Refund policy.
SECTION 4 - PRICES AND PAYMENT
All prices are shown in Norwegian kroner (NOK) and include 25% Norwegian value added tax (merverdiavgift, MVA).
Shipping costs come in addition to the product price and are always shown at checkout before you pay:
- Norway: 79 kr (Posten, with tracking). Free shipping on orders of 1,599 kr or more.
- Denmark, Finland and Sweden: 149 kr.
- Europe (Austria, Czech Republic, France, Germany, Italy, Netherlands, Poland, Romania, Slovakia): 199 kr.
For orders delivered outside Norway, the authorities in your country may charge import VAT or customs fees. These are paid by the recipient on delivery, as described in our Shipping policy.
The price you pay is the price shown when you place your order, as set out in your order confirmation. Prices, discounts and promotions may change, but changes do not affect orders already confirmed. Promotions may have their own terms; if they conflict with these Terms, the promotion terms apply, but never in a way that reduces your mandatory consumer rights.
You can pay using the payment methods shown at checkout. You confirm that you are entitled to use the payment method you choose and that the payment information you provide is correct.
SECTION 5 - SHIPPING AND DELIVERY
We ship from Norway. Processing times, delivery estimates, rates and other details are described in our Shipping policy. Delivery times are estimates. If a delivery is significantly delayed, you have the rights set out in the Consumer Purchases Act (forbrukerkjøpsloven).
The risk for the goods passes to you when the goods have been delivered to you, that is, when you or someone you have authorised take possession of them. Please check your shipping address carefully at checkout; we cannot be held responsible for orders sent to an address that was entered incorrectly.
SECTION 6 - INTELLECTUAL PROPERTY
Our Services, including all trademarks, brands, text, displays, images, graphics, product reviews, video and audio, and the design, selection and arrangement thereof, are owned by KULT ARCHIVE, its affiliates or licensors and are protected by Norwegian and international copyright, trademark and other intellectual property laws.
These Terms permit you to use the Services for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store or transmit any of the material on the Services without our prior written consent, except as permitted by law. Nothing in these Terms grants you a licence or other rights under any patent, trademark, copyright or other intellectual property of KULT ARCHIVE, Shopify or any third party. All rights not expressly granted are reserved by KULT ARCHIVE.
KULT ARCHIVE's names, logos, product and service names, designs and slogans are trademarks of KULT ARCHIVE or its affiliates or licensors. You must not use them without our prior written permission. Shopify's name, logo, product and service names, designs and slogans are trademarks of Shopify. All other names, logos, product and service names, designs and slogans on the Services (including Videnoir and Restyle) are the trademarks of their respective owners.
SECTION 7 - OPTIONAL TOOLS
You may be given access to customer tools offered by third parties as part of the Services, which we do not monitor or control. We provide access to such tools "as is" and "as available", and to the extent permitted by law we are not liable for your use of optional third-party tools. Any use of these tools is at your own discretion, and you should make sure you are familiar with and approve of the terms on which they are provided by the third-party provider(s).
We may in the future offer new features through the Services (including new tools and resources). Such new features will also be part of the Services and are subject to these Terms.
SECTION 8 - THIRD-PARTY LINKS
The Services may contain materials and links to websites provided or operated by third parties (including embedded third-party functionality). We are not responsible for the content or accuracy of third-party materials or websites. If you leave the Services to visit them, you do so at your own risk, and to the extent permitted by law we are not liable for any harm or damage related to your use of third-party websites or your purchase of products or services from them. Please review the third party's policies before you enter into any transaction. Complaints, claims or questions about third-party products and services should be directed to the third party.
SECTION 9 - RELATIONSHIP WITH SHOPIFY
KULT ARCHIVE is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our store are made directly with KULT ARCHIVE. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and KULT ARCHIVE, including any injury, damage or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages and liabilities arising from or related to your purchases and transactions with KULT ARCHIVE. This does not affect your rights against KULT ARCHIVE as the seller.
SECTION 10 - PRIVACY POLICY
All personal information we collect through the Services is processed in accordance with the General Data Protection Regulation (GDPR) as it applies in Norway and with our Privacy policy. Certain personal information may also be subject to Shopify's Privacy Policy, which can be viewed here.
Because the Services are hosted by Shopify, Shopify collects and processes personal information about your access to and use of the Services in order to provide and improve the Services for you. Information you submit to the Services will be transmitted to and shared with Shopify as well as third parties that may be located in countries other than where you live, in order to provide services to you. See our Privacy policy for more details on how we, Shopify and our partners use your personal information and on your rights.
SECTION 11 - FEEDBACK
If you submit, upload, post, email or otherwise send us ideas, suggestions, feedback, reviews, proposals, plans or other content (together, "Feedback"), you grant us a worldwide, royalty-free, non-exclusive licence to use, reproduce, modify, publish, distribute and display that Feedback in any medium, including for commercial use, for example to operate, improve and promote the Services.
You confirm that: (i) you own or have all necessary rights to your Feedback; (ii) you have disclosed any compensation or incentives received in connection with your Feedback; and (iii) your Feedback complies with these Terms. We are not obliged to keep Feedback confidential, to pay for it or to respond to it.
We may, but are not obliged to, monitor, edit or remove Feedback that we consider unlawful, offensive, threatening, defamatory, obscene or otherwise objectionable, or that violates anyone's intellectual property or these Terms. Your Feedback must not violate the rights of any third party, including copyright, trademark, privacy or other personal or proprietary rights, and must not contain unlawful, abusive or obscene material or any malware. You may not use a false email address, pretend to be someone else or otherwise mislead us or others about the origin of any Feedback. You are responsible for the Feedback you submit and its accuracy.
SECTION 12 - ERRORS, INACCURACIES AND OMISSIONS
Occasionally there may be information in the Services that contains typographical errors, inaccuracies or omissions relating to product descriptions, pricing, promotions, offers, shipping charges, transit times or availability. We reserve the right to correct such errors and to update information at any time. If an order was placed at an obviously incorrect price or with other obviously incorrect information, which you understood or should have understood was a mistake, we may cancel the order, also after it has been confirmed. In that case we will notify you as soon as possible and refund any amount you have paid in full.
SECTION 13 - PROHIBITED USES
You may access and use the Services for lawful purposes only. You may not access or use the Services, directly or indirectly: (a) for any unlawful or malicious purpose; (b) in breach of any applicable law or regulation; (c) to infringe our intellectual property rights or the intellectual property rights of others; (d) to harass, abuse, insult, harm, defame, slander, disparage or intimidate any of our staff or any other person; (e) to transmit false or misleading information; (f) to send, knowingly receive, upload, download, use or re-use any material that does not comply with these Terms; (g) to transmit, or procure the sending of, any advertising or promotional material, including any "junk mail", "chain letter", "spam" or any other similar solicitation; (h) to impersonate or attempt to impersonate any other person or entity; or (i) to engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the Services, or which may harm KULT ARCHIVE, Shopify or users of the Services, or expose them to liability.
In addition, you agree not to: (a) upload or transmit viruses or any other type of malicious code that will or may affect the functionality or operation of the Services; (b) reproduce, duplicate, copy, extract, sell, resell or exploit any portion of the Services; (c) collect or track the personal information of others; (d) spam, phish, pharm or pretext the Services; (e) use any robot, spider, scraping, data gathering and extraction tools, automatic devices or processes, AI tools (such as agentic AI) or automated or manual means to access the Services, except as permitted under Section 14; or (f) interfere with, bypass or circumvent the security or authorisation features, robot exclusion headers or other measures we use to restrict access to the Services.
We may suspend, disable or terminate your account if you have violated these Terms. Where reasonable, we will tell you why. This does not affect orders already confirmed or your consumer rights in respect of them.
SECTION 14 - AGENTS
14.1 This section ("Agent Terms") applies if you use, allow, enable or cause the deployment of an Agent to access, use or interact with any Services. "Agent" means any software or service that takes autonomous or semi-autonomous action on behalf of, or at the instruction of, any person or entity and that can be executed on behalf of or using a person's device, without direct supervision.
14.2 No Agent may access, use or interact with the Services unless, at all times, it identifies itself and operates in strict accordance with the requirements in section 14.4 below. In addition, no Agent may access, use or interact with the Services if we have requested that the Agent refrain from doing so.
14.3 We may limit, including by technical measures, whether and how any Agent accesses, uses and interacts with the Services.
14.4 Agents must: (i) in all HTTP/HTTPS requests, identify that the request is from an Agent and disclose the name of the Agent by including the following in the request's user agent string: "Agent/[agent name]"; (ii) not conceal or obfuscate that any access, use or interaction is from an Agent, such as by (a) mimicking human behaviour and interaction patterns, or (b) completing or circumventing CAPTCHAs or measures intended to distinguish computer use from humans; (iii) respond truthfully to any question or prompt seeking to determine whether interactions are coming from a human or a computer; and (iv) not circumvent or otherwise avoid any measure intended to block, limit, modify or control whether and how Agents access, use or interact with the Services.
SECTION 15 - TERMINATION
We may terminate this agreement or your access to the Services (or any part of them) if you breach these Terms or if we close the store. You remain liable for amounts due up to the date of termination. Termination does not affect orders already confirmed or your rights as a consumer in respect of them. The following sections continue to apply after termination: Intellectual Property, Feedback, Termination, Disclaimer, Limitation of Liability, Your Liability, Severability, Waiver; Entire Agreement, Assignment, Governing Law and Disputes, Privacy Policy, and any other provisions that by their nature should survive termination.
SECTION 16 - DISCLAIMER
General information on the Services (for example styling content and blog posts) is provided for general information purposes, and we do not guarantee that it is complete or always up to date. We do not guarantee that the Services will always be uninterrupted, timely, secure or error-free.
This section does not apply to the products you buy from us. Products must match the description and the requirements of the Consumer Purchases Act (forbrukerkjøpsloven), and your rights if there is a defect or delay cannot be excluded or limited by these Terms.
SECTION 17 - LIMITATION OF LIABILITY
To the extent permitted by law, KULT ARCHIVE is not liable for indirect or consequential loss arising from your use of the Services, such as lost profits, lost revenue or loss of data.
This limitation does not apply to loss caused intentionally or through gross negligence by us, to personal injury, or to liability we have under mandatory law, including your rights under the Consumer Purchases Act (forbrukerkjøpsloven) and the Cancellation Act (angrerettloven). Nothing in these Terms limits Shopify's or our liability where such limitation is not permitted by law.
SECTION 18 - YOUR LIABILITY
If you breach these Terms or the law when using the Services, or infringe the rights of a third party, you are liable for the loss this causes KULT ARCHIVE, Shopify and our partners in accordance with the general rules of Norwegian law, including reasonable legal costs related to third-party claims. We will notify you promptly of any such claim.
SECTION 19 - SEVERABILITY
If any provision of these Terms is found to be unlawful, void or unenforceable, that provision shall still be enforced to the fullest extent permitted by applicable law, and the unenforceable part shall be deemed separated from these Terms. This shall not affect the validity and enforceability of the remaining provisions.
SECTION 20 - WAIVER; ENTIRE AGREEMENT
If we do not exercise or enforce any right or provision of these Terms, this does not mean we have waived that right or provision. These Terms, together with the policies referred to in them and your order confirmation, make up the entire agreement between you and us regarding your use of the Services and your purchases, and replace any previous versions of the Terms of Service.
SECTION 21 - ASSIGNMENT
You may not transfer or assign this agreement or any of your rights or obligations under these Terms without our prior written consent. We may transfer our rights and obligations under these Terms to another business, for example if the store is sold, provided that this does not reduce your rights. We will inform you if this happens.
SECTION 22 - GOVERNING LAW AND DISPUTES
These Terms and any purchase you make from us are governed by Norwegian law. If you are a consumer living in another country, you also keep the protection of the mandatory consumer law of your country of residence.
If you are not happy with a purchase, please contact us first at hello@kultarchive.no. We will try to find a solution together with you.
If we cannot agree, consumers can contact the Norwegian Consumer Council (Forbrukerrådet, forbrukerradet.no) for advice and mediation. If the dispute is still not resolved, the case can be brought before the Consumer Complaints Committee (Forbrukerklageutvalget). Consumers living in another EU/EEA country can get help with cross-border complaints from the European Consumer Centre in Norway (Forbruker Europa, forbrukereuropa.no) or the European Consumer Centre in their own country. The European Commission's list of consumer dispute resolution bodies is available at consumer-redress.ec.europa.eu. (The EU's former online dispute resolution (ODR) platform was closed on 20 July 2025.)
Legal proceedings shall be brought before KULT ARCHIVE's home court (verneting), Buskerud tingrett (Buskerud District Court). This does not apply where mandatory law gives a consumer the right to bring a case before, or only be sued before, the courts where the consumer lives, and it does not prevent consumers living in Norway from first bringing a case before their local conciliation board (forliksrådet).
SECTION 23 - HEADINGS
The headings used in these Terms are included for convenience only and do not limit or otherwise affect these Terms.
SECTION 24 - CHANGES TO THE TERMS OF SERVICE
You can review the most current version of the Terms of Service at any time on this page. We may update, change or replace parts of these Terms by posting the changes on our website. We will notify you of material changes in accordance with applicable law. The Terms that apply to a purchase are the Terms in force when you placed your order; later changes do not apply to orders already placed.
